The seven principles of the General Data Protection Regulation (GDPR) are fundamental guidelines that govern the processing of personal data. These principles are:
- Lawfulness, fairness, and transparency: Personal data must be processed lawfully, fairly, and in a transparent manner in relation to the data subject. This means there must be a legal basis for processing, and individuals must be informed about how their data is being used.
- Purpose limitation: Data must be collected for specified, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes. Exceptions include processing for archiving, scientific, historical, or statistical purposes, provided appropriate safeguards are in place.
- Data minimisation: Personal data collected should be adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed. This principle ensures that only the minimum amount of data required is collected and retained.
- Accuracy: Personal data must be accurate and, where necessary, kept up to date. Every reasonable step must be taken to ensure that inaccurate data is erased or rectified without delay. This helps maintain the reliability and trustworthiness of the data.
- Storage limitation: Data should be kept in a form that permits identification of data subjects for no longer than is necessary for the purposes for which the data is processed. Data may be stored longer only for archiving, research, or statistical purposes, provided appropriate safeguards are implemented.
- Integrity and confidentiality (security): Personal data must be processed in a manner that ensures appropriate security, including protection against unauthorized or unlawful processing, accidental loss, destruction, or damage, using appropriate technical or organizational measures.
- Accountability: Controllers are responsible for and must be able to demonstrate compliance with the other principles through documentation, governance frameworks, and records of processing activities. This includes implementing privacy by design and default, conducting impact assessments, and maintaining audit trails.
