The “one form” that overrides both a will and a trust every time is the beneficiary designation form.
While wills and trusts are comprehensive legal documents, assets with specific beneficiary designations—such as life insurance policies, IRAs, 401(k)s, and Payable-on-Death (POD) or Transfer-on-Death (TOD) accounts—bypass both documents entirely.
Upon death, these assets transfer directly to the named individual on the form filed with the financial institution, regardless of conflicting instructions in a will or trust.

How Account Titling Overrides Everything

Beyond beneficiary forms, how an asset is titled serves as another powerful override mechanism. The legal ownership structure recorded on a deed or account agreement dictates the transfer of assets, often superseding estate planning documents.
